Will of Daniel Carter - Cecil County, MD - August 4, 1849 - Entered into probate April 4, 1851.
To whom it may concern know ye, that I Daniel Carter of Cecil County in the state of Maryland, being inform and weak of body , but of sound and disposing mind memory and understanding; Knowing the certainty of death and the uncertainty as to the time when it must happen, and being disirous to settle my worldly affairs, and be thereby better prepared to go, when it may be God's will to call me home, do make this my last will and testament as follows viz ... First and principally I commit my soul to God, and my body to the earth to be decently buried.
Secondly. I direct that my funeral expenses, and all my just debts be paid by my executors, as soon as may be convenient after my decease.
Thirdly. I give and bequeath to my dear wife all such household goods or personal property as she may choose to keep, and likewise the Interest of all monies that may remain of my estate, after payment of debts and funeral charges as aforesaid, for her decent and comfortable support and maintenance, yearly during her lifetime, but should the said Interest be insufficient for that purpose, then, and in that case I hereby will and direct that she shall draw from the principal sum, from time to time and from year to year, so much as will, with the interest asforesaid, be sufficient and satisfactory to her, for a decent and comfortable maintainance during her lifetime; and after her decease I give and bequeath all the residue and remainder of my estate to be distributed as follows
Fourth. viz. To my son in law, John Justison, the sum of one hundred dollars (provided he presents no claim against my estate.
Fifth To my daughter Margaret, wife of the aforesaid John Justison, the sum of fifty dollars.
Sixth To my two grandsons, Alfred and George, the children of my deceased son James, the sum of of fifty dollars each.
Seventh To my four sons, viz Joseph, Daniel, Silas, and Jeremiah all the residue and remainder of my estate, to be equally divided among them share and share alike.
And lastly I appoint my dear Brother Cloud Carter and my friend Frisby Tull executor of this my last will and testament, revoking and annulling all former wills by me heretofore made, ratifying and and confirming this and none other as my last will and testament.
In testimony whereof I have hereunto set my hand and affixed my seal this eleventh day of August in the year of our Lord One thousand eight hundred and forty nine.
