Suit No. 250 in the 76th Judicial District Court, Liberty County, Texas, E.F. Moore of Stearns County Minnesota vs. unknown heirs of Melina Whittington lists "Earnest Whittington of Orange County" among the 38 defendants. The papers for this suit were served on Earnest at Orange, Texas October 21, 1918. A handwritten note from him to Agna (his sister ?) exists stating that he had made copies of the papers for her. Inclusion as a defendant in the suit and thinking it necessary to make copies for another seem to infer that he was a close relative of Melina and Elisha.
