- (1) Aire A. Finley's Last Will
I Aire A. Finley of Camden, Benton County, Tennessee being of sound mind but frail in health hereby make, declare and publish, this as my last Will and Testament:
1st
I direct that my body be burried in a respectable manner and that all my burrial expenses be paid bymy Executor herein after named, and of any funds that I may have on hand at the time of my death, or that may first come into his hands as such Executer.
2nd
I direct that my Executor pay all my just and bonified debts.
3rd
I direct that said Executor call ? all ? accounts and other debts due me as spedily as to him may seem expedient, and turn over same as here in after directed.
4th
I give and bequeth to my brother Carlos R. Finley my one fifth (1/5) individual interest in and to a tract of land, lying and being at the ? D? the same being the home place of my father N. E. Finley, at the time of his death, and bounded on the North by the N. C. & St. Louis R. R. on the West by the ? road leading from Camden to Coxburg, on the South by Castile and Hudsonand on the East by Castile.
Also my one tenth (1/10) individual interest in a tract of land in the 5th Civil district of Benton County near the Camden depot bounded on the North by the N.C. and St. L. R. R.; South by Stubs(?) and Saunders(?). East by W.A. Stubs Jr. and on the West by Marris(?) the same being the old home place of my Grandfather Finley Also one ? lot in the town of Gathy Okla.
5th
It is my will and wish that my brother, Carlos R. Finley, have all money and personal effects which I may have and my Executor is hereby directed to pay the same to him after first paying my funeral expenses and bonified debts as herein mentioned; except the sum of Twenty Five Dollars which I direct my same Executor to retain for the purpose of erecting a monument to my Mother's grave.
6th
It is my wish and will that should my sister Clara Finley be married at the time of my death, then and in that event she andmy brother Carlos R. are to share equally herein each having a one half, or should my sister Lovinia Ayers wife of R. W. Ayers, be not living with her husband as man and wife and dependent on my brother Carlos R. at the time of mydeath, then and in that event it is my wish and will that she the said Lovinia have a one third (1/3) interest in and to the property herein mentioned, but should my sister Clara be not married and my sister Lovinia be living with her husband and not dependent upon my brother Carlos then and in that event my said brother Carlos R. is to be the sole benificiary of all the property, both personal and real here in defined(?), my Executor is as directed(?).
7th
I direct my Executor to collect what money I may have in the banks also a ? yet due me from the Estate of my grand father A. J. Hudson, when paid to the Clerk and Master of the Chancery Court of Benton County Tenn., and dispose of same as here in directed.
I here by nominate and appoint W. L. Morrisas my Executor who shall not be required to execute bond as such executor. In witness where of I have here unto set my hand, this 3rd day of August 1905.
