    Notes 
    • (1) Served in Company D, of the 56th Regiment of the Illinois Volunteer Infantry
      Mustered in as an "unassigned recruit" Feb. 1, 1864 at Metropolis, Massac County, Illinois. He is assigned to Co.D, 56th Infantry on Feb 2, 1864 and mustered out Aug 12, 1865 at Little Rock, AR. Description lists him as 18 years old, 5 ft, 6 in. tall, light hair, blue eyes, and light complexion. Occupation farmer. Term of enlistment is given as 3yrs. Newton enlisted with James Riley Finley, age 36 who served in the same company but is listed as "deserted July 25, 1865". This is interesting because I have a record of James R. Finley, son of Joshua Finley. I don't know exactly who these folks are but they lived next door to Austin Finley's family and Austin's parents Thomas Jonathan and Mary Reeder Finley. My guess is James R. is Newton'smuch older cousin.
      (2) 1880 census gives age 32, occupation "silver smith".
      (3) I have a copy of the Last Will and Testament of Newton R. Finley. It reads as follows;
      "I N. E. Finley being of sound mind but feeble in health, and knowing that all men must die, and not knowing how soon I may pass away, and having a desire to direct the manner in which my effects may be disposed of after my decease do make and publish this my last will and testament, hereby revoking and making void any and all other wills by me made at any time.
      1st
      I direct that my body be burried in a respectable manner and my burial expenses be paid as soon thereafter as can be done of whatever effects I may leave.
      2nd
      It is my will that my beloved wife L. C. Finley have all of my property real and personal for the uses and benefit of her self and my children Effie, Carlos, Lovie, Arie and Clarie Finley equally.
      3rd
      That she continue tosell goods or to follow any other legitimate business that she may like or think best but this clause is not intended to compel her to follow any particular business and she may cease to do any kind of public business when in her opinion she believes the same does not justify her in following said business.
      4th
      I have a small tract of land on the Tennessee River in the 11th Civil District of Benton County Tennessee known as the Oakhill (?) land that I desire my wife to sell but for a sum not less than three hundred and fifty $350.00 dollars, also one half 1/2 interest in the place in the 5th Civil District of Benton County bounded on the north by the NC and St. Louis Railroad, south by Steele and Sounders (?) , east by W. A. Steele Sr., west by Maddis (?), it being the same place which my father lived and I direct that she sell the place where we now live in connection with the store but for a sum not less than eight hundred $800.00 and if she does or should sell said property or either of said lands and property I autherize her to make a deed or deeds tothe purchaser or purchasers in as full and ample a manner as if I had done the same in my lifetime, but I reserve the right to convey any of the above named lands during my lifetime if I see fit to do so and for any consideration and in case my wife L. C. Finley shall sell said lands the proceeds shall be controlled by her for her benefit and the benefit of my children above named.
      5th
      I autherize my wife L. C. Finley to collect all of my debts that may be due me at my death and ? for same and to make any settlement with any parties that may be owing me at my death or that I may owe, and the same shall be as legal and binding upon her and them as if I had done the same in my lifetime. And I further direct that my wife L. C. Finley transact any and all other business of my estate and without being required to give bond or qualify in any court of record(?) but the ? probate in the proper court of this will shall be the evidence upon which she will act. 6th
