Otto Cloud Is Sentenced At Rochester
Enters Surprise Guilty Pleas To Charges of Forgery and Obtaining Money Illegally
ROCHESTER, Ind., -- Otto Cloud, former merchant and banker of Macy, Monday afternoon was fined $500 and costs and sentenced to serve 2 to 14 years in the state prison after he waived arraignments in the Fulton circuit court and pleaded guilty to two grand jury indictments for forgery and obtaining money under false pretenses returned against him here July 13, 1938.
On the first count of forgery the court fined him $300 and meted a 2 to 14 year sentence. On each of the following counts for forgery, five in all, he was fined $10 and costs and meted terms of 2 to 14 years.
On the first count for obtaining money under false pretenses, Cloud was fined $100 and costs and sentenced to serve 1 to 7 years in prison. On each of the following counts for obtaining money under false pretenses he was fined $10 and costs and meted 1 to 7 year terms.
The sentences will run concurrently so that the prisoner will actually serve only the one 2 to 14 year sentence, officials announced.
The plea of guilty came as a surprise for it was believed that Cloud would stand trial. He was represented in court by Paul Butler, of South Bend, who pleaded for leniency.
The former banker was charged in the indictments with having defrauded the First National bank and the Farmers and Merchants bank, both of Rochester, in conditional sales contracts which bore forged signatures.
Cloud formerly operated grocery and appliance stores in Rochester, Macy, Fulton, Bourbon and Nappanee. At the time of his indictment he was also president of the Macy bank, which closed soon afterward.
He and members of his family are under indictment at South Bend for the same offense.
The alleged fraud scheme of the Clouds consisted of selling chattel mortgage papers to two or three different banks or loan companies, using the same security for all of them. Otto Cloud offered the mortgages on his chain of household appliance stores.
Those arrested in July, 1938, with the elder Cloud were Richard Cloud, 29, Paul Cloud, 33, Mrs. Paul Cloud, 27, of Bourbon; W. Henry Erwin, 24, and his wife, Virginia, 23, of Bourbon; and Orvan Van Lue, 29, Rochester.
Cloud was to be taken to prison today by Sheriff Russell Vorhees.
