      Death of Woman Follows His Unexpected Return From Victoria Yesterday Evening.

      J.P. (Jake) Volz was arraigned in Justice Flak's court at 10:30 o'clock this morning on a charge of murder as the result of the killing of Mrs. Volz at 11 0'clock last night at their home, 306 Rural avenue.  He waived examination and was bound over without bail to await the action of the grand jury.  The charge was filed by City Detective Joe Stowe.

      According to neighbors, the shooting occurred when Mrs. Volz returned home after visiting the couple's former home on Muncey street.  Volz had returned unexpectedly from Victoria, where he is playing ball, earlier in the evening and was waiting for his wife on the front gallery of their home.  They spoke a few words when it is said Volz pulled a pistol and shot her.  The bullet struck her in the right eye and lodged in the brain.  Death was almost instantaneous.
      Husband Surrenders Pistol.
      Immediately after the shooting Volz went to a neighbor's house and told the latter to telephone for the police.  Mounted Patrolman Inglehardt, Pipes and Phillips and Detective Miller responded and the latter took Volz into custody after he had surrendered a 38-calibre pistol.
      Joe Gaugler, 318 Rural avenues, states that Mrs. Volz was at his home about 7 o'clock last evening and expressed a desire to visit her former home on Muncey street to ascertain if any letters had come there from her husband.  T.J. Flaugh, driver of a moving van, who was present, overheard the remark and offered to take Mrs. Volz to the Muncey street house.  She at first demurred, but upon being reassured by Mrs. Gaugler, took her little son and accompanied Flaugh.
      Mrs. Mae Schonjeldt, residing next door to Volz, says that Volz came home and finding his wife was absent inquired as to her whereabouts.  He was told she had gone out driving and after entering the house and lighting a lamp, Volz returned to the front gallery and taking a seat on the steps,

      waited until Mrs. Volz appeared.
      Told Neighbors of Trouble.
      When Volz appeared at the Baugler home after the shooting, he told the story of the trouble to Mr. Gaugler.  According to Volz, he had heard a buggy come up along the street and had heard Mrs. Volz say:
      "Oh, Jake is home."
      Then, he said, the buggy was turned about and the horse whipped into a gallop, leaving the scene.  Volz is said to have fired one shot after the vehicle and then turned to his wife who had approached him.
      She, he said, appeared excited and when he asked where she had been, replied:
      "Don't ask me Jake."
      The fatal shot was then fired at close range and Mrs. Volz sank to the ground still grasping the hand of her little son, who had accompanied her.
      Husband Is Ball Player.
      Mrs. Volz was formerly Mrs. Zuercher, and was married to Volz nearly two years ago.  She was 23 hears old.  Her mother, Mrs. Pauline Mattke resides in Bexar county and a brother, Louis Cloud, is a resident of San Antonio.  They have taken charge of the body and of the home where the tragedy occurred.
      Relatives of Mrs. Volz this morning endeavored to locate P.J. Flaugh, the man with Mrs. Volz previous to the shooting, but were unable to do so.
      Jake Volz is 34 years old and was born in San Antonio.  He began his baseball career in the city league and entered the Texas league with the Austin club.  Then he went to the Virginia league and later to the New England league.  He was given a tryout with Boston.  He played in the Connecticut league, the Wester league and the South Atlantic league.  He returned to San Antonio a year ago, tried out with the Bronchos, later joined the Waco club and this year was playing with Victoria in the Southwest Texas league.
      His parents, several brothers and sisters, reside in San Antonio.
      William Zuercher, the divorced husband of Mrs. Volz, accompanied by his mother, called at the Sloan & Hagy mortue this morning.
      The funeral of Mrs.Volz will be held Sunday afternoon at 4 o/clock from the Sloan & Hagy chapel and interment will be made in the Odd Fellows' cemetery.  Rev. O. Hartmann will conduct the services at the chapel and grave.
